Purposes of data processing, legal basis, and duration of data storage

We process personal data on the website we operate for the following purposes:

Contact form and email

When you contact us (for example, by email or using the contact form), the information you provide will be processed for the purpose of handling your inquiry and in the event that follow-up questions arise.

Data processing is carried out on the basis of Art. 6 para. 1 lit. f) GDPR. According to this, data processing is lawful if the processing is necessary to safeguard the legitimate interests of the controller or a third party, unless the interests or fundamental rights and freedoms of the data subject requiring the protection of personal data prevail, in particular if the data subject is a child. Our legitimate interest lies in processing the contact request. You can object to this data processing at any time if there are reasons that exist in your particular situation. To do so, simply send an email to info@elsmannimmobilien.de.

The personal data stored in the context of establishing contact will be deleted once the matter associated with the contact has been fully clarified and it is unlikely that the specific contact will be relevant again in the future.

Server log files

When you use the website for informational purposes only, i.e., if you do not register or otherwise provide us with information, we only collect the personal data that your browser transmits to our server. The so-called server log files include:

The personal data in log files is processed on the basis of Art. 6 para. 1 lit. f) GDPR. According to this, data processing is lawful if the processing is necessary to safeguard the legitimate interests of the controller or a third party, unless the interests or fundamental rights and freedoms of the data subject requiring the protection of personal data prevail, in particular if the data subject is a child.

Our "legitimate interest" consists in providing our website, facilitating administration, and enabling us to detect and track hacking. The server log files containing the above data are automatically deleted after 7 days at the latest. We reserve the right to store the server log files for longer if there are facts that suggest the assumption of unauthorized access (such as an attempt at hacking or a so-called DDOS attack).

We have an agreement with bitmex GmbH for commissioned data processing in accordance with Art. 28 GDPR. bitmex GmbH acts and processes the data exclusively in accordance with our instructions.

Within our company, only those persons who are required and need to perform their tasks receive personal data.

Your obligation to provide personal data (Article 13(2)(e) GDPR)

The provision of your personal data on this website is generally not required by law or contract. Scope of processing

Purposes of processing

Transfer to third countries

Storage period

The data sent by us and linked to cookies is automatically deleted after 14 months. Data that has reached its retention period is automatically deleted once a month. Ynfinite

We use the Ynfinite Content Management System from Ypsolution GmbH, Overstolzenstr. 2a, 50677 Cologne, Germany (hereinafter: Ynfinite CMS) to display our website.

Ynfinite CMS is hosted on a central server environment that is not under our control. This server environment is located in Frankfurt. All German data protection regulations apply. Ynfinite CMS only stores personal data if this has been expressly agreed to, e.g., by submitting a form. Ynfinite CMS processes the personal data that is absolutely necessary for the operation of the website. In order to load the website, images, and scripts, your IP address is required to establish a connection to the Ynfinite CMS servers. After the connection is established, this IP address is only stored in log files that are kept for a short period of time for troubleshooting purposes and is then discarded.
